Under Section 28 Health & Safety at Work Act 1974 regarding Legionella Risk Assessment extends to residential rental properties so there is a need by those with the responsibility of owning or managing residential rental properties to demonstrate compliance.


How does this legislation affect Landlords, Property Managers and Letting Agents?

To meet the legal duty in ensuring that the risk of exposure to tenants to legionella is properly assessed and controlled it is recommended that a legionella risk assessment is carried out every two years.

So what is Legionella?

Legionellosis is a collective term for diseases caused by Legionella bacteria including the most serious Legionnaires’ disease.  Legionnaire’s is a potentially fatal disease with flu-like symptoms often mistaken for pneumonia contracted by inhaling bacteria contained in water droplets.  The risk increases with age, medical and social conditions therefore some tenants may be at higher risk.

The bacterium Legionella pneumophila and related bacteria are common in natural water sources such as rivers, lakes and reservoirs, but usually in low numbers. Whilst the bacteria at low levels do not pose a health risk, under certain conditions, in water storage tanks, both hot and cold, for example, and in certain temperature ranges, the bacteria can multiply increasing the risk of Legionnaire’s Disease.

The risk of Legionella increases in water systems which are unused for any period of time which makes rental properties particularly vulnerable.
